The terms governing accounts, purchases, delivery, and use of the AtlasFresh online retail store.
AtlasFresh is an online retail trading brand operated by Atlas Digital Assets LLC and is not a separate legal entity or marketplace. These Terms form an agreement with Atlas Digital Assets LLC. By using the store or placing an order, you agree to these Terms and the policies linked at checkout, subject always to rights that cannot lawfully be waived.
You must be at least 18 and legally capable of contracting, or use the store under the supervision and authority of a responsible adult. If ordering for a company or other organisation, you confirm that you have authority to bind it and that delivery and import arrangements are lawful for its intended use.
Descriptions, origin, quantities, grades, sizes, photographs, weights, preparation, packaging, allergens, and storage information are provided as accurately as reasonably possible. Fresh produce and fish naturally vary in colour, shape, size, weight, ripeness, texture, appearance, and seasonal characteristics. Photographs are representative, not a promise of an identical item. Product availability and shelf life can change quickly.
Displayed prices use the selected currency and may exclude shipping, duties, import charges, or taxes until destination and delivery details are known. Applicable totals are shown before submission where calculable. We may correct obvious listing, availability, currency, tax, or pricing errors. If an accepted order is affected, we will seek approval for the corrected terms or cancel and refund the affected amount as required by law.
Submitting an order is an offer to purchase; an automated receipt only confirms receipt and does not guarantee acceptance. Acceptance occurs when AtlasFresh sends an express acceptance or begins fulfilment, depending on the stated checkout process. We may refuse, limit, or cancel an order for insufficient or unsafe stock, supply interruption, payment failure, suspected fraud, legal or import restrictions, delivery limitations, product safety, abuse, or an obvious listing or pricing error. Any captured amount for a cancelled item will be resolved appropriately.
Payments are processed using the third-party methods enabled at checkout. Those providers may impose their own terms and conduct fraud or identity checks. Cash on delivery is offered only when specifically enabled for the destination, cart, customer, and delivery method. AtlasFresh does not promise that every payment method is available for every order.
Processing time and transit time are separate. Delivery dates are estimates unless expressly guaranteed. Risk and title transfer as required by applicable law and the stated delivery terms. Inspect perishable goods promptly, store them at the required temperature, and report spoiled, unsafe, damaged, missing, incorrect, or materially non-conforming goods under the Fresh Product Satisfaction & Resolution Policy. Because of food-safety and hygiene requirements, physical returns of perishable goods are generally unavailable.
You must comply with the Acceptable Use Policy. You may not interfere with security, create fraudulent orders or accounts, introduce malware, abuse automated systems, scrape unlawfully, misrepresent information, infringe rights, or disrupt AtlasFresh or its integrations.
The AtlasFresh brand assets, website design, text, software, product content, and compilation are owned by or licensed to Atlas Digital Assets LLC and protected by applicable intellectual-property laws. These Terms grant only a limited, revocable, non-transferable right to use the store for lawful personal or authorised business purchasing.
Payment, authentication, delivery, tracking, communication, maps, and other integrations are provided by third parties and may be subject to separate terms. We are not responsible for independent third-party acts beyond the responsibility that applicable law requires, but we remain responsible for our own obligations to customers.
To the fullest extent permitted by law, the website is provided without warranties beyond those expressly stated, and Atlas Digital Assets LLC is not liable for indirect, incidental, special, exemplary, or consequential loss that was not reasonably foreseeable. Nothing excludes liability that cannot lawfully be excluded, including applicable liability for fraud, wilful misconduct, death or personal injury caused by negligence, defective products, or mandatory consumer guarantees. Any permitted aggregate limitation will not reduce non-waivable remedies.
Where legally enforceable, a business user agrees to indemnify Atlas Digital Assets LLC against third-party claims caused by that user's unlawful misuse, infringement, or material breach. This clause does not apply to the extent a claim was caused by Atlas Digital Assets LLC or where consumer law prohibits it.
These Terms are governed by the laws of New Mexico, United States, without regard to conflict-of-law principles. This choice does not deprive a consumer of mandatory protections or courts available in the consumer's habitual residence or jurisdiction. We may amend these Terms prospectively. The version and effective date will change, and material changes will receive notice or renewed acceptance where required. Contact: support@atlasfresh.org.
